Special K Femina Covergirl Contest 2014 :
** Participate in the Special K Femina Special Covergirl Contest, ("Contest") by sharing your story on how you Got back to life by overcoming your excuses and did something you wanted to do. The winner of the best story stands a chance to appear on the cover page of one issue of Femina magazine ("Prize"). Other exciting stories stand a chance to appear on limited edition packs of Kellogg's Special K.
** To participate in the Contest, follow the instructions appearing on www.femina.in/specialcovergirl. By participating in this Contest, it is deemed that you have read and agree to these Terms and Conditions.
** The Contest is valid from 5th September, 2014 to 1st October, 2014. All dates are subject to change.
** Only one story (entry) per participant, received through the website, www.femina.in/specialcovergirl, will be eligible to participate in the Contest. Multiple entries received using other logins will be considered invalid. Entries received after the deadline set forth in the Contest announcement are ineligible, null and void. Femina will not be responsible for and will not consider incomplete or incorrect entries or entries not received by Femina for any reason.
** In case any participant uploads any entry which is obscene, defamatory, libelous, threatening, invasive of privacy or publicity rights or otherwise objectionable, or which constitute or encourage a criminal offence, violate the rights of any party or otherwise gives rise to liability or violates any law, the same shall be rejected by Femina and Kellogg India in their discretion and such participation shall not be considered for the Contest.
** Only permanent residents of India who have attained the age of 18 years, are eligible to participate in this Contest. The participants should be natural born s. Employees of Femina, Kellogg India, and their affiliates, subsidiaries, representatives and immediate family members of the employees of Femina and Kellogg group companies are not eligible to participate in the Contest.
** All entries will be judged by Femina and Kellogg India jointly. The decision of the judges will be final and binding and no further queries/correspondence will be entertained in this regard by Femina and Kellogg India.
** Femina and Kellogg India will jointly contact the winners through e-mail. Names of winners will be announced on www.facebook/Specialkindia and www.facebook/FeminaIndia
** In the event that Femina does not receive any response from the winner within three working days of intimation to the winner, Femina and Kellogg India reserve the right to select the next best entry at their discretion.
** Femina and Kellogg India also reserve the right to select an alternative winner, in the event that Femina and Kellogg India have reasonable grounds to believe that a selected winner has contravened any of these Terms and Conditions. The joint decision of Femina and Kellogg India shall be final and binding and no further correspondence will be entertained in this regard.
** All entries upon submission become the joint property of Femina and Kellogg India. By participating in this Contest, the participants are deemed to have provided their irrevocable consent to Femina and Kellogg India to use the entries and their photographs, digital images, video recordings, audiotapes and the like for the purpose of creating advertising and promotional materials to be used in all forms of media including without limitation, analog, digital or interactive media including internet, CD/CD Rom/DVD, posters, banners, print media such as magazines, newspapers, danglers, hoardings, leaflets, etc., without any compensation whatsoever worldwide and in perpetuity. The participants release Femina and Kellogg India and its agents and assigns forever from any and all claims which arise out of or in connection with such use.
** The participant agrees to provide complete and correct information with respect to her identity, contact details, age, education, profession and such other information as may be required by Femina. Participants are required to furnish necessary supporting documentation in original and any other documentary proof as may be required by Femina to confirm the eligibility of the participants. Participants agree to do all acts and execute any and all documents in such manner and at such location as may be required by Femina and Kellogg India in their absolute discretion.
** Registrations for the participation in the Contest shall be only through the method set out in these Terms and Conditions. Femina reserves the right to introduce any other methods of participation in the Contest. The participation in the offer is entirely voluntary and it shall be deemed to have been made on a voluntary basis.
** Femina and Kellogg India may at their discretion choose other exciting stories from the entries received by them. Kellogg India reserves the right to print such entries and the photograph of the participant on the limited edition packs of Kellogg's Special K without any consideration whatsoever. Kellogg India may contact such participants to provide their photographs and other necessary details, as may be required in such form and manner as may be requested by Kellogg India.
** Winners must claim the Prize and submit all documents for reviews in the manner communicated by Femina and Kellogg India. In case the winner fails to contact the specified person on or before the designated date i.e., [ ] the winner shall be deemed to have surrendered the Prize. The Prize under this Contest is non-cashable, non-transferable and cannot be exchanged for cash or for anything of value.
** Femina and Kellogg India and its agencies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or jumbled, scrambled transmission, communications line failure, theft, destruction, or unauthorized access to the microsite, website of Femina or program or programming error or failure, or failure to capture any entry information. Femina and Kellogg India and its agencies are not responsible for injury or damage to the participant's or to any other person's computer, other equipment, or person relating to or resulting from participation in the Contest, or from downloading materials or accessing the website or microsite's of Femina or Facebook.
** Any participant using manipulative means to garner more votes or jeopardise any other participant's entry by any means shall be banned from the Contest.
** Femina and Kellogg India reserve the rights to withdraw or alter the terms of this Contest without prior notice. No correspondence in this regard shall be entertained. All changes shall be posted on the websites. It is the responsibility of participants to keep themselves informed as to any changes to the terms of this Contest.
** For the sake of clarity, the Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook.
** Purchase of Kellogg's Special K is not a condition precedent to participate in this Contest.
** Any participant found to be copying other participant's or non-participant's images or text or using any unauthorized or copyrighted images or text shall be immediately banned from the Contest. Femina and Kellogg India shall not be liable for any copyright claims arising so forth. Femina and Kellogg India shall not be responsible in any manner to anybody including any of the participants for the misuse of any or text submissions at this Contest.
** Participants warrant that their stories are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted stories, images and content and that they have the right to submit the story including text and images, in the contest and grant all required licenses. Each participant agrees not to submit any story that : (a) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; or (b) otherwise violates applicable law; or (c) has been previously entered in any competition or won any award. Participant acknowledges that participant's representations, warranties, indemnities, dispute mechanism and obligations shall survive the efflux of time and the termination of these Terms and Conditions.
** The participants and winners agrees that she shall hold harmless the Femina, Kellogg India, their employees, officers or any other person from and against any and all claims, damages, obligations, losses, liabilities, costs, debt and expenses (including but not limited to attorney's fees) arising from (i) use of and access to Facebook for the Contest under these terms; (ii) your violation of any term of the Contest; (iii) any violation of any third party right, including without limitation any copyright, property, or privacy right. This indemnification obligation will survive these Terms and Conditions and the participant's participation in the Contest.
** Participant acknowledges that in case any clause of these Terms and Conditions is deemed invalid or becomes unenforceable or prohibited by the law of the country, such portions shall be considered divisible and shall not be part of the consideration, and the remainder of these Terms and Conditions shall be valid and binding and of like effect as though such provision was not included herein.
** Decision of Femina and Kellogg India management is final and binding. The terms and conditions of this Contest are subject to the laws of Republic of India. All disputes shall be subject to the exclusive jurisdiction of competent courts in Mumbai.
