Criminal Law II
Criminal Procedure Code, 1973, Juvenile Justice (Care and Protection of Children) Act, 2000 and Probation of Offenders Act, 1958 (Course III)
Duration : 3 Hours Max. Marks : 100
Instructions :
1. Answer all five Questions.
2. One essay type and one short note question or problem from each unit have to be attempted, which is referred as part (a) and (b) in all the units.
3. Figures to the right indicate marks.
4. Answers should be written either in English or Kannada completely.
UNIT I
Q. No. 1. (a) Explain the procedure of trial before the Court of Sessions. Marks : 15
OR
What do you mean by arrest ? Who can arrest ? Explain rights of the person arrested.
(b) A, an accused, is charged with an offence of belonging to a gang of dacoits, operating in Madhya Pradesh. He is arrested in Mumbai. Can he be tried for the offence in the Mumbai Court ? Marks : 5
OR
A teacher raped his student twice and threatened her not to disclose it to anybody. After three months she complained stomachache to her mother on medical examination it was found that she is pregnant. After that FIR was lodged. Can delay in filing FIR be condoned ? Give reasons.
UNIT II
Q. No. 2. (a) Explain the provisions relating to attachment of property of person absconding ? Marks : 15
OR
Explain the contents of charge. Discuss the consequences in the event of an alteration in a charge.
(b) Mr. X commits a defamation of Mr. Y, a Yoga Guru. Can a disciple of Mr. Y file a complaint for the defarmation ? Decide with reasons. Marks : 5
OR
Mr. A has committed four offences of embezzlement within a period of one year. Can he be tried for all offences at one trial ?
UNIT III
Q. No. 3. (a) Explain the manner in which a judgement is to be delivered and what a judgement should contain ? Marks : 15
OR
A person who has been tried for an offence and convicted or acquitted shall not be liable to be tried for the same offence explain
(b) A and B were convicted for criminal breach of trust and sentenced for one years rigorous imprisonment and a fine of Rs. 1,000/- Both A and B filed an appeal in the High court. B died pending appeal. Subsequently the High court passed an order on As appeal, reversing his conviction. There after one of Bs relatives applied to the High court to set a side the conviction of B and order the fine be refunded. How such an application should be decided by the court ? Marks : 5
OR
W obtained order for payment of maintenance from the court of magistrate at Delhi against H. After that H came and settled at Hubli. One magistrate passed execution of the order of maintenance at Hubli. Is it valid ? Give reasons.

Q. No. 4. (a) Discuss the rules relating to time limitation for taking cognizance of certain offences. Marks : 15
(b) Execution of sentence of death. Marks : 5
UNIT V
Q. No. 5. (a) Explain the schemes available for rehabilitation and social reintegration of Children under Juvenile Justice (Care and Protection of Children) Act, 2000. Marks : 15

Discuss the constitution and powers of Juvenile Justice Board.
(b) Power of court to release certain offenders on probation for good conduct. Marks : 5
