UNIT I
Q. No. 1. (a) Analyse the provisions made under Advocates Act 1961 towards legal profession. Marks : 10

Q. No. 3. (a) Analyse the objectives and purposes of Contempt of Court Act 1971. Marks : 10

Enumerates the defences available in civil contempt. Marks : 10
(b) Answer the following problem :
A an advocate withdraws suit on oral instruction of associates of the plaintiff as it was settled without the instruction from the plaintiff. Whether this amounts to misconduct. Explain with reference to a case In Re an advocate AIR 1989 SC 245. Marks : 6

B an advocate did not attend the Court in pursuance of a call for strike by the Bar Association and the case was dismissed. Does it amount to misconduct ? Marks : 6
UNIT IV
Q. No. 4. (a) A appointed Y as his advocate and handed over all documents and information about the case. However subsequently A found that Y is incompetent in handling his case and asked him to retire. As per the instruction Y retires from the case thereafter Y agreed to handle the opponent case.
Is it justifiable ? Refer decided cases. Marks : 10

In a case a senior advocate filed an application for transfer of the case from the Bench hearing it to another bench of the high court as justice could not be received from the hands of the Honble Judge as they were prejudiced against the applicant. Does this amount to contempt of court ? Justify by giving reasons. Marks : 10
(b) Answer the following :
A Magistrate commented on a decision of higher court order passed by the incompetent judge and warned the counsel in a very furious manner with dire consequences. Is it amount to contempt of court ? Marks : 6

Discuss the misappropriation of clients money with reference to the opinions of disciplinary committee of Bar Council of India. Marks : 6
