    1. Answer all five (5) Questions.
    2. One essay type and one short note question or problem from each unit have to be attempted, which is referred as part (a) and (b) in all the units.

    Q. No. 1. (a) Discuss the salient features of adversarial and inquisitorial methods. Explain their advantages and disadvantages. Comment. Marks : 9

    UNIT – II
    Q. No. 2. (a) What is an arbitration ? Who can appoint arbitrators ? State the required qualifications of the arbitrators. Marks : 9

    Explain the salient features of the arbitration and Conciliation Act, 1996.
    (b) Kinds of arbitration. Marks : 3

    ‘A’ is appointed as a sole arbitrator by ‘B’ and ‘C’ to settle their dispute. ‘A’ and his wife invested in ‘B’ company. ‘A’ gives verdict in favour of B.C discovers this after two months of the Award. Can ‘C’ ask for setting a side of the award ?

    Q. No. 3. (a) What is meant by conciliation ? Discuss the law relating to appointment and removal of conciliators. Marks : 9

    Explain the role of conciliator in conciliation proceedings.
    (b) ‘R’ is a conciliator. ‘P’ and ‘Q’ are the parties in a conciliation proceeding. Upon termination of conciliation proceeding ‘R’ fixes the costs of conciliation proceeding and gives a written notice to ‘P’ and ‘Q’. Costs included fees, expenses, experts advice and travelling expenses of ‘R’, his wife and two children. Advice P and Q. Marks : 3
