    Fourth Semester of Three Year LL.B. Examination, June 2011
    PUBLIC INTERNATIONAL LAW (Course – I)
    Duration : 3 Hours Max. Marks : 100

    Instructions :
    1. Answer all 5 Questions.
    2. One essay type and one short note question or problem from each unit have to be attempted, which is referred as part (a) and (b).
    3. Figures to the right indicate marks.
    4. Answers should be written in English or Kannada completely.

    UNIT – I
    Q. No. 1. (a) Explain the various sources of International Law. Marks : 15
    OR
    Discuss the operation of International Law within the British Municipal Sphere.
    (b) Write a note on : Weakness of International Law. Marks : 5
    OR
    Monistic theory.

    UNIT – II
    Q. No. 2. (a) Define State. Explain the essential elements of the State. Marks : 15
    OR
    What is meant by recognition ? Critically examine the various theories of recognition.

    (b) Write a note on “Condominium”. Marks : 5
    OR
    In a dispute between State ‘A’ and State ‘B’ over an Island ‘C’, State ‘A’ claims the title to it on the basis that State ‘X’ had discovered that Island first and it sold the same to State ‘A’. But State ‘B’ argues that the Island is in its continuous peaceful possession for more than 70 years and hence it had right over it. Decide.

    UNIT – III
    Q. No. 3. (a) What is territorial jurisdiction of the state ? State the principles governing the territorial jurisdiction. Marks : 15
    OR
    Define State succession. State the consequences of state succession in respect of
    i) Treaty rights and obligations
    ii) Contractual rights and obligations.

    b) Write a note on : Marks : 5
    “The Continental Shelf ”.
    OR
    The king of State ‘A’ during his stay in State ‘B’ promised to marry Ms. Mary. Subsequently the promise was not fulfilled. Ms. Mary files a case in State ‘B’ for breach of promise. Decide.

    UNIT – IV
    Q. No. 4. (a) Explain the various modes of acquiring and loss of Nationality. Marks : 15
    OR
    What is extradition ? State the conditions for extradition.
    (b) Write a note on Marks : 5
    Classification of International Treaties.
    OR
    The diplomat of State ‘A’ was supplying weapons to a banned out fit in violation of local laws, in State ‘B’. When he was caught, he claims diplomatic immunity. Can he succeed ?

    Q. No. 5. (a) Explain the functions of General Assembly. Marks : 15
    OR
    State the dispute settlement mechanism of World Trade Organization (W.T.O.).
