Ltd, a company having its registered office at D-100, Okhla Industrial Area, Phase-I, Delhi-110020 (hereinafter referred to as “WORLD PHONE”) in association with Idea Cellular Limited, a company having its registered office at Suman Tower, Plot No. 18, Sector – 11, Gandhinagar – 382 011 and Corporate Office at 5th Floor, Windsor, Off CST Road, Kalina, Santacruz (E), Mumbai-400098 (hereinafter referred to as ‘Idea’) (WORLD PHONE and Idea shall be jointly referred to as ‘Organizers’)and the OFFER is open for a limited period from 21st Oct 2014 00:00:01 hrs till 31st Dec 2014 23:59:59 hrs for the pre-paid as well as post-paid category of Idea’s subscribers1 for the below mentioned circles. This OFFER is being brought to you by WORLD PHONE and the gratifications of the Challenge are sponsored by WORLD PHONE exclusively for the Subscribers of Idea. Idea is merely providing its base and SMSC to facilitate the Challenge.

 An Idea Subscriber, by participating in the OFFER, hereby agrees to the Terms and Conditions mentioned below and gives his/her express consent to the process of selecting the “Highest Scorer(s)” as set out herein, and any appropriate changes that may be made to this OFFER by the Organisers due to any legal or regulatory or other requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of the Organisers, its affiliates and associates.

 [B][U]Procedure and Eligibility to participate[/U][/B]:
      [B][U]This OFFER is valid for all active Prepaid and Postpaid Idea Subscribers who fulfill the following criteria[/U][/B]:
      Subscriber must be of or above 18 years of age.
      Subscriber must be a citizen of India.
      He/she must not have any criminal record nor be of an unsound mind and must have a firm contractual capacity.
      He/she must not have any been either convicted and / or prosecuted for commission of any criminal offence.
      He/she must not be under any legal disability e.g. insolvency, restraint by court order etc. and / or is prohibited from entering any contractual relationship.
  
 If the Highest Scorer(s) eligible for Gratification is not able to provide sufficient evidence to show that he/she is the Subscriber of the mobile number, the Organisers reserve the right to award the Gratification to the next eligible Highest Scorer(s) or to forfeit the Gratification, at their sole discretion.
 
     [B][U]OFFER on Voice[/U][/B]:
      The OFFER will be available by dialing 55315 and will be charged at Rs. 9/min for all Subscribers of Idea in the above mentioned telecom circles of Idea.
 
     The Subscriber dials the 55315 and gets the option to play either OFFER or various other options to navigate around the IVR flow. If Subscriber selects the Offer he shall land on the Offer page wherein details of the Offer shall be at option 1, Option 2 shall be questionnaire which the Subscriber has to answer correctly for getting eligible for the Gratification under this OFFER. Any 10 questions relating to Astrology or Devotional questions shall be asked to the participant in the first round and another 10 questions in the second round.
 
 If a participant plays the OFFER and has started playing the OFFER on In-dial and has scored 10 points in 1 question, if he/she drops the call and resumes playing through SMS, he/she will be given the 2nd question, and if he/she answers the question correctly, his/her score will be 20 and this will be the score that will be considered for the highest scorer’s selection for all the gratifications.
 
    [B][U]Charges[/U][/B]: 
 [B][U]Charges for this OFFER are as under[/U][/B]:
      Subscriber dials 55315 and can answers the question or talk to Pandit. Charge Rs. 9/min
 
 Subscriber shall mean the rightful user of the connection, in whose name the mobile phone number (MSISDN) is registered with Idea. In the event the Subscriber’s number / connection is registered in the name of a Company/ Firm, the employee who is authorized to use the phone shall submit a No Objection Certificate and authorization of the employer duly permitting the employee to use the number for participation in the OFFER, receive the Gratification and accept the terms applicable for the OFFER .
 
        [B][U]Gratifications and selection of the Highest Scorer[/U][/B]: 
     10 Gold Coin (1gm Each)
 
 The selection for the Gold Coin Highest scorer will be conducted at the end of the OFFER. 10 (Ten) Participants, across all circles, with the highest score, in the shortest possible time, will be selected as the Highest Scorer(s) to get Gold Coin.
      100 Silver Coins (10 gm each)
 
 The selection for the Silver Coin Highest scorer will be conducted at the end of the OFFER. Participant, across all circles with highest score, in the shortest possible time, post selection of Gold Coin Highest scorer will be selected as the Highest Scorer to get Silver coin
  
     In case of a tie between two or more participating Subscriber(s) in the selection of any of the Gratifications, the selection of the Highest Scorer shall be done on the basis of MOU’s (Minutes of Usage) generated on the other options.
 
      In case of a further tie in the tie-breaker round, the Highest Scorer(s) shall be selected based on their age on the network, i.e. the MSISDN who has been there in the network/with the operator(Idea) for longer time shall be selected as the Highest Scorer(s).
 
     All Gratifications will be given after deducting various taxes, license fees and charges as applicable. Highest Scorer has to submit advance Demand Draft of TDS amount of the Gratification in favor of “WORLD PHONE Communications Ltd”
 
     The list of Highest Scorers of all gratifications will be announced after the end of the OFFER and after Highest Scorers’s selection processes are completed.
 
      After the selection and validation of the highest scorers of all the above mentioned gratifications, the highest scorers will be contacted, through SMS or calls, for 3 consecutive days, and will be given further details as to how, when and where they can redeem their respective gratifications. The gratifications must be claimed by the highest scorers within one month of the date of intimation, failing which, the gratification will be forfeited. The highest scorers shall be required to provide their address to which the gratifications may be sent by Organiser, by calling the number provided in the SMS. Delivery of gratifications will be subject to the highest scorers giving the correct address and his/her availability there. The highest scorers agree that there shall be no liability on the Organisers in the event such message does not reach such highest scorer on any account whatsoever. In the event that any of the highest scorers cannot be reached or are ineligible or are disqualified, for any reason whatsoever, the Organisers reserve the right to forfeit the gratification/s at their sole discretion.
 
     To be eligible to claim the gratifications of the OFFER, the winning MSISDNs have to be active subscribers of Idea during successful highest scorer announcement period. The Highest Scorers shall not be entitled to the gratification(s), in case he/she fails to clear all outstanding dues payable to Idea.
 
      The Gratification is subject to availability and there will be no cash alternative. The Highest Scorers are eligible for such gratifications will be liable to pay any applicable charges over and above the ex-showroom price which shall include but not be limited to applicable taxes or any other costs or charges which may be levied by the Central, State or Municipal authority / government or any other liabilities related to the gratification.
 
     The Gratifications offered in this OFFER will be sponsored and distributed by WORLD PHONE. The Gratification/s offered in this OFFER may be given (but not obligated to) to the Highest Scorer during a special event, the venue, date and time of which shall be announced by the Organisers, at their sole discretion, subsequent to the completion of the OFFER.
  
     This OFFER is being made purely on a “best effort” basis and participation of eligible subscribers is voluntary, and subject to acceptance of these Terms and Conditions.
  
     By entering the OFFER, you confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and you agree to receive promotional messages/calls from WORLD PHONE/ the Organisers, as they may in their sole and absolute discretion decide. Once you participate you agree that we can send any type of communication for the next 30 days.
 
     Participant shall directly contact WORLD PHONE at 0120-4770474 regarding any queries / complaints pertaining to the OFFER anytime between 9.30 AM to 6.30 PM, on all working days from Monday to Friday. Alternatively, the Participant can send an email to [EMAIL="sandeep@callwpi.com"]sandeep@callwpi.com[/EMAIL] during the same time on all days. All disputes must be addressed by the Participant in writing to WORLD PHONE directly and Idea shall not entertain any communication in this regard. Further, any information that the Participant may request in connection with the OFFER, may be provided by the Organisers to the Participant, at the sole and absolute discretion of the Organisers, depending on the nature of the information requested, and any such information may be provided only during a period of 60 days from the end of the OFFER. No such request shall be entertained thereafter.  The Organisers further clarify that any information requested by any Participant shall only concern that Participant and under no circumstances will the Organisers provide confidential information or information pertaining to other Participant(s).
 
     By participating in the OFFER , participants consent to the following information relating to them to be exchanged between Idea, WORLD PHONE and their concerned vendors and/or published or otherwise communicated to in any media that the Organisers may deem fit, for the purpose of the successful highest scorer announcement: name, address, mobile phone number, score and/or photograph.
 
     You acknowledge and agree that all copyright and trade-marks and all other intellectual property rights in the SMS content/ WAP/ website and all material or content related to the OFFER shall remain, at all times, owned by WORLD PHONE/ the Organisers / their respective owners. All material and content contained in this website is made available for your personal and non-commercial use only. Any other use of the material/ content on this website/WAP site and/ or any information disseminated by SMS or any other means of communication is strictly prohibited.
 
      Idea/WORLD PHONE is neither responsible nor guarantees the quality of the goods/ services being offered as gratifications nor is it liable for any defect or deficiency of goods or services so obtained/availed, by the Participants under this OFFER. WORLD PHONE is also not liable for any defect/ deficiency in the gratification(s) so offered or availed, by the Participants under this OFFER. Participants shall not have the right to claim any damages, loss or costs from Organisers for delay in delivery of the gratifications(s) on any grounds whatsoever.
 
      The gratification(s) under the OFFER is neither assignable nor transferable under any circumstances. All the gratifications shall be subject to such other Terms and Conditions as may be applicable to specific gratifications and shall have to be duly complied with by the Successful Highest scorer
 
      The gratification(s) to the Successful highest scorer shall be given subject to compliance with all applicable statutory legislations/ processes /formalities in connection with the gratification(s) and on production of all such documents/papers as may be required by Idea/WORLD PHONE before accepting the delivery of the gratification. Any failure on the part of the highest scorer to comply with directions issued by Idea/WORLD PHONE for claim of gratification, shall entitle Idea/WORLD PHONE to forfeit the gratification(s). WORLD PHONE at its sole discretion shall decide the model/variant of any gratification being offered in this OFFER. Mere participation in the OFFER shall not entitle a participant to the gratification.  No other person or agent can claim the gratification on behalf of the Successful highest scorer.
 
      All gratifications offered in this OFFER are subject to availability. The Organisers, at their sole discretion, may or may not provide an alternative to the gratifications being offered as gratifications in this OFFER.
 
      All incidental costs/taxes/levies related to the gratification(s), if any, shall be exclusively borne by the Participant including but not limited to TDS, Gift tax (if any), Road Tax, Insurance and any other taxes applicable by the Central, State or Municipal government.
  
     A Participant shall be considered ineligible if he/she does not conform to the conditions as stipulated in these Terms and Conditions, or cannot provide any of the required documents as stipulated in clause 26 herein below.
 
      All gratifications must be claimed by the Successful highest scorer, along with the documents specified herein below. The documents required to be submitted along with the claim by the Successful highest scorer include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law):
      Identity Proof 
     Address Proof 
          Proof of holding the Idea telephone connection 
     Photocopy of PAN Card 
     Letter of Compliance with rules and regulations and declarations in the format as may be required by Idea etc.[/QUOTE]
